1.2. Voyager Marine Solutions Limited is a registered New Zealand company (Company Number 9358342), trading as “Voyager Marine Solutions”, “Voyager Marine”, and “Voyager Marine Education”.
1.3. These Terms and Conditions govern your use of our websites and services, including but not limited to purchasing courses, using course materials, employing our consultancy services, undertaking maritime examinations, and interacting with our platforms.

2. Eligibility
2.1. By accessing and using this website, you warrant that you are at least 18 years of age or have the consent of a legal guardian.
2.2. You agree to provide accurate and up-to-date information when creating an account or purchasing services.

3. Use of Website and Content
3.1. By using the Website (www.voyager-marine.com) or our learning platform (learn.voyager-marine.com), you agree that you accept these Terms and that you will comply with them.
3.2. If you do not agree to these Terms, you must not access or use the Website or platform.
3.3. Please read these Terms carefully and print a copy for future reference. We do not retain a copy on your behalf and these Terms may be updated from time to time.
3.4. All content on our websites and learning platforms (including text, images, videos, and course materials) is owned by or licensed to Voyager Marine Solutions Limited. You may not copy, reproduce, distribute, or modify any content.
3.5. Course materials are provided for personal use only. Redistribution, resale, or sharing of login credentials is strictly prohibited.
3.6. You agree not to use the Website or platform for any unlawful purpose or in any way that could impair their functionality, security, or availability.
3.7. Voyager Marine Solutions Limited will not be responsible for any loss or damage caused by a distributed denial-of-service (DDoS) attack, viruses, or other technologically harmful material that may infect your computer equipment, programs, data, or other proprietary material due to your use of our Websites or your downloading of any material posted on them, or on any website linked to them.

4. Course Registration and Payment
4.1. When purchasing products, booking services, or enrolling in online courses, you are required to create an account and provide accurate payment details.
4.2. All prices are listed in New Zealand Dollars (NZD). Payment must be made in full unless otherwise agreed.
4.3. We offer both one-off purchases and subscription plans. You are responsible for managing your account and payment details.

5. Refund and Cancellation Policy
5.1. Refunds: A full refund may be requested within 7 days of purchase, provided no significant portion of the course has been accessed. Refunds are not available for completed or partially completed courses. Please note that no refunds will be granted in the event of examination failure, as outlined in Section 9.3.
5.2. Cancellations: You may cancel your subscription or registration through your account. Cancellation requests must be made before the next billing cycle to avoid further charges.
5.3. Refunds, where approved, will be processed within 14 business days.
5.4. Voyager Marine Solutions Limited is not liable for any issues with Maritime New Zealand certification processes, including delays, application errors, or refusal to issue certificates, as detailed in Section 9.4.
6. User Conduct
6.1. You agree to act respectfully toward other users during interactive sessions and within the Voyager Community Forum. Harassment or inappropriate conduct will result in immediate termination of access without refund.
6.2. You are solely responsible for maintaining the confidentiality of your account information, including passwords.
7. Intellectual Property Rights
7.1. All intellectual property rights in the content, design, and materials provided on this website and learning platform are owned by Voyager Marine Solutions Limited. This includes (but is not limited to) course materials, written content, graphics, logos, videos, and digital resources.
7.2. You may use course content solely for your personal learning purposes. Copying, reproducing, modifying, or distributing any content without prior written consent is strictly prohibited.
7.3. Voyager Marine Solutions Limited reserves the right to take legal action to protect its intellectual property if these rights are violated.

9.3. Voyager Marine Solutions Limited does not guarantee success in any Maritime New Zealand examination, nor will refunds be issued in the event of examination failure.
9.4. Voyager Marine Solutions Limited is not liable for any issues relating to your certification process with Maritime New Zealand, including application errors, delays, or refusals to issue a certificate.
9.5. In all cases, Voyager Marine Solutions Limited’s total liability to you (whether in contract, tort, or otherwise) is limited to the total amount paid by you for the specific service that gave rise to the claim.
9.6. Under no circumstances will Voyager Marine Solutions Limited be liable for any loss of business, revenue, profits, goodwill, or anticipated savings, or any other indirect or consequential loss, even if we have been advised of the possibility of such damages.

10. Changes to Terms and Conditions
10.1. We reserve the right to update these Terms and Conditions at any time. The latest version will be posted on this page with the effective date.
10.2. Continued use of our websites and services constitutes acceptance of the updated terms.
11. Termination
